Question
I am a 26 year old single mother of a 2 year old girl. My fiancé & I broke up a month ago. Reason being he was cheating. I tried very hard to patch things up but it didn't work out. Now he wants our daughter to live with him permanently & I totally disagree with him.
I'm petrified that he might take this matter to court. Please help. What can I do?
Answer
There is no reason she should live with him, and she is only 2 years old, so she needs her mom as well as visits from dad. No court will take custody from a mother unless she is mentally ill or has a drug problem, and even then they will find alternative foster care if the mom is unhappy about the child being placed with dad, while they investigate. In this case, his track record is not good (the cheating), so it looks even less likely he could even raise the issue in court! If he ever did raise it, see a family advocate instead.- Colinda Linda
