What to do when raped

Here's what you need to know about rape to enable you to report it properly.

What is the definition of rape?
According to our courts it is intentional, unlawful sexual intercourse with a man, woman, boy or girl-child without his/her consent. This includes marital rape, date rape, anal rape and penetration with a foreign object.

What should you do if you were raped?

  • You will want to take a bath or shower after the incident, but whatever you do DON'T!! Crucial evidence will be lost. Doctors can take skin samples from under your nails or find DNA evidence in your body.
  • You must go to a police station as soon as possible. You have the right to request to speak to a woman police officer in a private place.
  • You may also go directly to a hospital or a district surgeon. Be careful to go to your GP, many of them are not trained to examine rape survivors and this may cause unnecessary run-around.
  • Make sure the doctor tests for HIV and other sexually transmitted diseases.
  • The doctor should also provide emergency contraception, antibiotics and antiretroviral medication to prevent HIV infection.
  • You have a choice to either just report the incident or to lay a formal charge. Be sure to ask for a reference number and a case number.

    What if you do not want to lay a charge?
    If you decide not to lay a charge, you can simply report the rape to the police and request no further investigation. They must record it in their occurrence book (OB) and give you the OB number.

    What happens if I decide to lay a charge?
    You do not have to lay a charge immediately, but it is highly recommended that you do it as soon as possible. The quicker you do it, the easier it is to get evidence that could be crucial in making an arrest.

    You can also ask the police to come to your home, if you do not want to go to the station.

    You must inform the police officer if you have been drinking or have taken any drugs.

    Take someone you trust with you to the police station. You have every right to ask to speak to a female police officer.

    When you report the incident, you must tell the police exactly what happened to you. Every small detail can help them. If you are very upset, the police will take a short statement from you and take a longer statement later on.

    You are allowed to make the statement in your home language. Be sure that you are happy with the statement, before you sign it. Remember that the court will question any changes that you make to the statement after you signed it. You may ask for a copy of your statement.

    Ask for your case number – you will have to use this number if you have any questions about your case later on.

    After you made your statement, the district surgeon will examine you.

    What happens if they catch your attacker?
    If the alleged rapist is arrested, there will be an identity parade. You will have to point him out, but you do not have to touch him. Most police stations have one-way glass, so he will not be able to see you.

    There is a good chance that he will be released on bail. You have the right to attend the bail hearing and give evidence about why you think he should not be released.

    Bail should not be granted if:

  • He raped you more than once
  • You were raped by more than one person and they were in it together
  • He already has more than 2 rape charges against him
  • He knew he had HIV/AIDS
  • You are under 16
  • You are made vulnerable by a physical disability
  • You are mentally ill
  • He inflicted grievous bodily harm during the rape

    Hi, i just want to inform the person that wrote this piece, that i know alot of girls that has been raped and they didnt lay a charge due to justice not being done and the way the police officers handles the matter, you already feel violated but then you have to tell a total stranger what happened and after that you are being harrast by them and questions like why were you alone and where you were going and do you know this guy. I know that some of this questions may be relevant but they are defniltely not properly trained for this and then nothing would come of it. I propose that the process of this is handled wrongly because the girls needs someone they can trust and feel comfatable with. Just my opionion.

    My son was Raped(sodomized) by a teenager (male) int he complex we used to live in. He was 7&8 at the stage. We laid a charge against the perpetrator at the local police station. To this day nothing was done about the charge or against the person, the reason - according to the police my 8 year old son is not able to give a detailed statement stating exact times, dates chronological occurrences etc. The justice and legal system in this country let him down and very often I am the one that needs to explain to him why the legal system let him down. I can understand why so little cases of rape is reported, as the victims are not supported and the perpetrators rights are placed above the violated rights of the victims.

    What kind of a crappy article is this. You cannot be tested for HIV just after being raped, you need to get ARV's, Please do proper research before writing crap and misinforming people. What an idiot to you, your editor and News 24!!!! All freakin IDIOTS!!!!!

    Sam, this may seem very insensitive to a rape victim and you may think at the end of the day what does it help? I think it's maybe because if you do end up becoming HIV positive because of the rape, the accused rapist's lawyers might just say you got it somewhere else, how do you prove you were not already HIV positive at the time of the rape if you don't get tested? It is not to see if you caught it from the rape but to prove you didn't have it in the first place. I know of medical personnel who pricked themselves accidentally with needles while working on HIV+ patients and first thing they did was test the medical people for HIV as a baseline so I think that's what its about. Hope that clears it up for you Sam. No need to get so angry and jump to conclusions like you did.

    Sam, the ARVs should be given as soon as the HIV test blood sample has been taken. And the ARVs are covered in the very next bullet point in the article, right after the blood tests. You are right about their importance, I know if I was raped, I would want to get a handful of them down my throat too, and they would be issued at the same place where the bloods are drawn, I would think. I don't believe the article was misinformation, merely a logically structured article. I know logic doesn't play much of a part in the aftermath of a rape and the victim may not feel the steps recommended are the right ones to take, or in the right order, but they make sense. It's just like the understandable urge to scrub oneself, it may be a natural urge but it doesn't help the case. There is more to a case than just catching a perpetrator, there is also the victim's dignity of course, but at the end of the day, the advice in the article seems to be validated by professional rape management professionals so a lot of thought has probably gone into it.

    Many police stations have trained volunteers who can be called and will lead the person abused through the process. This can be a much kinder way for the victim. Every police station has to have a separate counselling room as well. I am surprised this was not mentioned.
